DC Jammu Orders For Cancellation Of All Permissions Issued For Holding Exhibitions/Fairs Amid Rising Covid-19 Cases

In view of the surge in Covid-19 cases, Deputy Commissioner Jammu Anshul Garg issued orders for cancellation of all permissions issued for holding Exhibitions/Fairs amid rising Covid-19 cases.

Whereas, it has been made to appear to me, in view of the situation emerging due to COVID-19 in District Jammu, that there is sufficient ground for proceeding under Section 144 of CrPC for immediate prevention or speedy remedy is desirable to prevent danger to human life, health or safety; and Whereas, Epidemic Diseases Act, 1897 and Disaster management Act, 2005 also empower the undersigned to issue certain directions for safety and preventing any harm to human life; and Whereas, there has been a sudden spike in number of COVID Positive cases which are being reported in the district over the last few days and Whereas, the State Executive Committee of Department of Disaster Management, Relief Rehabilitation & Reconstruction vide Government Order No 11-JK(DMRRR) of 2021 dated 30/03/2021, has issued revised guidelines / instructions, regulating activities within the Union Territory of Jammu and Kashmir for effective containment of COVID-19 w.e.f. 1st April, 2021 to 30th April, 2021 and Whereas, as per Para No 4 of the Annexure to the J&K Government order No 11-JK(DMRRR) of 2021 dated 30/03/2021, empowering this office to take local preventive measures for checking spurt of infections in our district, reads an order.

“Now, therefore, I, Anshul Garg, lAS, District Magistrate, Jammu, vide powers conferred upon me under section 144 of CrPC read with relevant provisions under the Epidemic Diseases Act, 1897 and the Disaster Management Act, 2005 do hereby order that all the permissions issued for holding exhibitions and fairs shall be deemed to have been expired forthwith.

The organizers of these exhibitions shall wind up their operations within 24 hours and concerned Sub Divisional Magistrates shall submit compliance report to this office.”

As per the order, any violation of this order shall invite punitive action under section 188 of Indian Penal Code and other relevant sections of Epidemic Diseases Act, 1897 and the Disaster Management Act, 2005. (PTK)
