SC refuses to entertain petition for repolling in some booths in Munger LS Constituency

The Supreme Court on Friday refused to entertain a writ petition filed by RJD candidate alleging booth capturing and rigging of election in the Munger Parliamentary Constituency of Bihar by members of the JDU with the support of government officials and seeking directions for re-polling in some booths.

The Apex Court dismissed the petition and granted liberty to the petitioner to approach the High Court.

While dismissing the petition, a Vacation bench of Justice Satish Chandra Sharma and Justice Prasanna B Varale said, “the High Courts are not closed in this country.

Please go to the High Court and argue all this before the High Court.”

The petitioner’s counsel Advocate Aljo Joseph in his petition before the Top Court had sought that direction be given to the Election Commission of India (ECI) to conduct re-polling in some booths of Lukhisarai Assembly Constituency, Mokana Vidhan Sabha Constituency; Suryagarha Assembly Constituency all of which are part of Munger Lok Sabha Constituency.

The petitioner also sought directions to ECI to remove District Magistrate Mr Avaneesh allegedly involved in the rigging.

It was further alleged that several representations had been given to the authorities including the observers of the Election Commission of India and District Election Officer Mr Avaneesh Kumar Singh but to no avail.

The petitioner also claimed that his party members were manhandled by the officials and followers of JD(U) when they tried to protest against the booth capturing.
