HC Reserves Verdict On Appeal By 3 ANC, NC Leaders Against ‘Detention’

Srinagar: Amid Jammu and Kashmir government’s claims that Mustafa Kamal—the NC additional general secretary and brother of party president Farooq Abdullah—and ANC chief Begum Khalida Shah along with her son Muzaffar Shah are free to go anywhere they want, the J&K High Court on Monday reserved its judgment on an appeal filed by them.

The division bench reserved the verdict after hearing Senior Additional Advocate General B A Dar and counsel representing the appellants.

In response to appeal filed by the three leaders in the High Court, seeking their release, the government informed the High Court that it has not put Mustafa Kamal, Khalida Shah and Muzaffar Shah under house arrest.

According to GNS, the Senior AAG said that the appellants are free to move anywhere. The counsel appearing for the appellants on the other hand contended that his clients were not being allowed to move outside.

Amid the claim and the counter claim, the court asked government to withdraw all kind of security which as per the appellants is not allowing them to move freely from their residences.

Last year, a single bench of the court had observed that the petition by the leaders is not maintainable and is unnecessary after communication submitted by SSP Srinagar stated that they have neither been put under house arrest at 10, Moulana Azad Road nor their liberty curbed.

In response to petitions filed by the three leaders in the High Court seeking their release, the government had informed the High Court that it has not put Mustafa Kamal, Khalida Shah and Muzaffar Shah under house arrest. The single bench’s judgment has been challenged by the leaders before the division bench of the court.  (GNS)
