HC upholds conviction of Kashmir terror recruitment case accused

Kochi, May 9 (UNI) Kerala High Court on Monday upheld the conviction and sentence awarded to nine people including prime accused and former self-styled south Indian commander of Lashkar-e-Taiba, Thadiyantavida Nazeer in the 2006 Kashmir terror recruitment case.

Pronouncing the verdict, the Division Bench of Justice K Vinod Chandran and Justice C Jayachandran, acquitted three accused in the case.

The second accused MH Faisal, 14th accused Muhammed Nawas and the 22nd accused Ummer Faruq were acquitted.
The accused recruited youths from Kerala and provided arms training to them to wage war against the country. The issue came to light when four of them were killed in an encounter with the security forces.

The Division Bench upheld the October 2013 Ernakulam NIA Special Court verdict convicting 13 people and acquitting five in the case.

Though the accused filed petition in High Court challenging the conviction, the NIA filed petition challenging the acquittal of other five people. The Court also considered the call record statement issued by BSNL as a major and additional evidence in the case.
