Court orders police inquiry against Nupur Sharma, others in Prophet comment row

A city court on Saturday directed Senior Superintendent of Police Srinagar to investigate whether there are sufficient grounds to proceed against former BJP spokesperson Nupur Sharma and three others for comments on Prophet Mohammad.

The court of City Judge  directed the SSP to conduct an inquiry under Section 202 of the CrPC and conclude it before July 28.

A lawyer Mohammed Ashraf Bhat had filed a complaint before the court against the now-suspended BJP spokespersons Nupur Shrama and expelled party leader Naveen Kumar Jindal. Navika Kumar, Editor Times Now and Kirtima Maravoor, the Compliance Officer of Bennett Coleman and Company Ltd (TV Division) and sought action against them for offences under sections of 120-B, 153A, 153B, 295 (A), 298 & 505(2) of the Indian Penal Code.
The complainant alleged that the accused persons acted with the common intention to hurt the religious sentiments of Muslim community.

After hearing the counsel for the complainant, the court today observed that all the accused persons reside outside the jurisdiction of the court and thus an inquiry under section 202 of Crpc becomes mandatory before issuing process against the accused persons.

“Thus the case is referred for investigation to SSP Srinagar under section 202 CrPc for ascertain whether or not there is sufficient ground for proceedings in the case. Inquiry shall be concluded before the next date of hearing which is fixed on July 18,” the court order read.
